Cancellation & Refund Policy

This Cancellation and Refund Policy (hereinafter referred to as “Policy”) sets forth the terms governing the cancellation of subscriptions, refund eligibility, and account credits applicable to Users of the Cinemate™ platform operated by Cinemate Technologies Private Limited (hereinafter referred to as “Cinemate,” “Company,” “we,” “us,” or “our”).

This Policy forms an integral part of, and shall be read in conjunction with, the Terms and Conditions available at www.cinemate.tech/terms-conditions.

1. Subscription Plans Overview

1.1. The Platform offers the following subscription tiers: Free, Plus, Pro, and Premium.

1.2. All paid Subscription plans (Plus, Pro, and Premium) include a three (3) day free trial period. The User shall not be charged during the trial period. If the User does not cancel prior to the expiration of the trial period, the applicable subscription fee shall be automatically charged.

1.3. Subscriptions are available on a monthly or annual billing cycle, as selected by the User at the time of purchase.

2. Free Trial

2.1. Each User is entitled to one (1) free trial per Account. Free trials are available on all paid subscription tiers (Plus, Pro, and Premium).

2.2. The free trial period is three (3) calendar days from the date of activation.

2.3. The User may cancel the free trial at any time prior to its expiration without incurring any charge. If the User does not cancel before the trial expires, the Subscription shall automatically convert to a paid Subscription, and the User shall be charged the applicable fee.

2.4. No refund shall be issued for failure to cancel a free trial before its expiration. It is the User’s sole responsibility to cancel the trial within the trial period if the User does not wish to be charged.

3. Cancellation of Subscription

3.1. The User may cancel their Subscription at any time by:

  • Navigating to the Account Settings or Billing section of the Platform and selecting the cancellation option; or
  • Contacting the Company at support@cinemate.tech with a request for cancellation.

3.2. Upon cancellation:

  • The Subscription shall remain active until the end of the current billing period (monthly or annual, as applicable). The User shall continue to have access to all features of their paid tier until the expiry of the billing period.
  • Upon expiry of the billing period, the Account shall automatically revert to the Free tier with the corresponding feature limitations.
  • User Content shall remain accessible in read-only mode for a period of thirty (30) days following the effective date of downgrade, during which time the User may export their Content. After this period, the Company reserves the right to permanently delete Content that exceeds the storage limits of the Free tier. For the avoidance of doubt, cancellation or deletion from the Company’s servers does not affect the User’s intellectual property ownership of their Content or AI-Generated Outputs.

3.3. The Company reserves the right to cancel or suspend a User’s Subscription at any time if the User is found to be in violation of the Terms and Conditions, applicable law, or this Policy.

4. Refund Policy

4.1. General Rule — No Refunds. All subscription fees paid by the User are non-refundable. The Company does not offer full or partial refunds for any Subscription, including but not limited to:

  • Unused portions of a monthly or annual Subscription.
  • Downgrade from a higher-tier plan to a lower-tier plan during an active billing cycle.
  • Failure to use the Platform during the Subscription period.
  • Dissatisfaction with the features, performance, or AI-generated outputs of the Platform.
  • Failure to cancel a free trial prior to its expiration.

4.2. Pro-Rata Credits. In lieu of refunds, the Company may, at its sole discretion, issue pro-rata account credits in the following circumstances:

  • When the Company discontinues a material feature or module of the Platform that was a primary component of the User’s Subscription tier.
  • When the Platform experiences a sustained and verified service outage exceeding seventy-two (72) consecutive hours that materially prevents the User from accessing the Platform.
  • In exceptional circumstances as determined by the Company on a case-by-case basis.

4.3. Account credits are non-transferable, non-cashable, and may only be applied towards future Subscription fees on the Platform. Account credits shall expire six (6) months from the date of issuance.

4.4. Chargebacks and Payment Disputes. If a User initiates a chargeback or payment dispute through their bank or payment provider without first contacting the Company at support@cinemate.tech, the Company reserves the right to immediately suspend or terminate the User’s Account pending resolution of the dispute. The Company encourages Users to contact support@cinemate.tech to resolve any billing concerns before initiating external payment disputes.

5. Plan Upgrades and Downgrades

5.1. Upgrades: When a User upgrades to a higher-tier plan during an active billing cycle, the upgrade shall take effect immediately. The User shall be charged a pro-rated amount for the remainder of the current billing cycle, calculated as the difference between the new plan fee and the unused portion of the existing plan fee.

5.2. Downgrades: When a User downgrades to a lower-tier plan, the downgrade shall take effect at the commencement of the next billing cycle. The User shall continue to enjoy the higher-tier features until the end of the current billing period. No refund or credit shall be issued for the difference between the higher and lower plan fees.

5.3. Annual to Monthly Conversion: If a User on an annual Subscription wishes to switch to monthly billing, the change shall take effect upon the expiry of the current annual billing period. No pro-rated refund shall be issued for the unused portion of the annual Subscription.

6. Account Termination by the Company

6.1. If the Company terminates a User’s Account for violation of the Terms and Conditions, no refund or credit shall be issued. However, the User shall be permitted to export their User Content for a period of thirty (30) days following termination.

6.2. If the Company terminates a User’s Account without cause (i.e., not due to any breach by the User), the Company shall issue a pro-rata credit for the unused portion of the User’s current billing period, which may be applied to a future Subscription or, at the Company’s sole discretion, refunded.

6.3. Regardless of the reason for termination, the User’s intellectual property ownership of their User Content and AI-Generated Outputs is not affected and survives any termination, cancellation, or expiry of the Subscription or Account.

7. How to Request a Cancellation or Credit

7.1. To cancel your Subscription, navigate to the Billing section of your Account on the Platform or send an email to support@cinemate.tech with the subject line “Subscription Cancellation.”

7.2. To request a pro-rata credit under the circumstances described in Section 4.2, send an email to support@cinemate.tech with the subject line “Credit Request,” including your Account email address, Subscription tier, and a detailed description of the reason for your request.

8. Governing Law

8.1. This Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
